This guide is based on the existing law on sexual offences which is contained in the Sexual Offences Act 2003 (SOA 2003). The SOA 2003 contains over 50 sexual offences. This guide explains the following offences:

  • Rape

  • Assault by penetration

  • Sexual assault

  • Causing someone to engage in sexual activity without consent

For further information about other sexual offences see the Home Office website and the CPS legal guidance on rape and sexual offences.

Before you look at each offence, it is important to understand two concepts that apply to all:

· what behaviour is sexual, and
· consent
